When a property is in probate, it means the owner has passed away and the property is going through the legal process of settling their estate.

what is probate?

Probate is the court-supervised process of:

  • Validating the deceased person’s will (if there is one) 
  • Identifying assets (like the house) 
  • Paying debts and taxes 
  • Distributing what’s left to heirs      

What it means for the Property

  • The property is still owned by the deceased person’s estate 
  • A court-appointed person (called an executor if there’s a will, or administrator if there isn’t) is responsible for it 
  • The home cannot be freely sold or transferred without following probate rules 

Can it be sold?

Yes—but with conditions:

  • The executor/administrator usually needs court approval (depending on the state and situation)      
  • The sale process can be slower than a normal transaction 
  • In some cases, the price may need to be confirmed by the court
